1099-NEC and 1099-K Thresholds for 2026: What Changed

For payments made in 2026, a client generally has to file Form 1099-NEC for you only if it paid you $2,000 or more for services during the year, up from $600, and the IRS says the $2,000 amount will be adjusted for inflation beginning in 2027. A payment app or online marketplace has to send Form 1099-K only if your payments exceed $20,000 and your transactions exceed 200, a test the 2025 tax law restored retroactively. Neither threshold changes what is taxable: all of your freelance income goes on your return whether or not a form arrives.

What the 2025 law changed, form by form

Public Law 119-21, enacted July 4, 2025 and commonly known as the One, Big, Beautiful Bill Act, made three changes that matter to freelancers.

The general reporting floor rose from $600 to $2,000. The IRS applies it to payments made after December 31, 2025, so forms for 2025 payments still used $600. On Form 1099-NEC the floor covers fees for services by anyone who is not the payer’s employee. On Form 1099-MISC it covers rents, prizes and awards, other income, medical and health care payments and crop insurance proceeds. Royalties stay at $10, gross proceeds paid to attorneys stay at $600, and the $5,000 direct-sales rule is unchanged. IRS Publication 1099 says the $2,000 figure will be adjusted for inflation beginning in calendar year 2027, so check the 2027 instructions before relying on it for next year’s payments.

Backup withholding moved with the floor. A payer withholds 24% from reportable payments when the payee has not provided a correct taxpayer identification number, and for these forms the threshold is now $2,000 as well.

The 1099-K test went back to its original form. Payment apps and online marketplaces, which the IRS calls third party settlement organizations, must file only when, for the calendar year, gross payments to you exceed $20,000 and the number of transactions exceeds 200. Both conditions must be met, so $25,000 received in 150 payments does not require a form. Publication 1099 now states this test for calendar years beginning after 2010, and California’s Franchise Tax Board notes that the IRS phase-in amounts ($5,000 for 2024, $2,500 for 2025 and $600 for 2026) no longer apply. For calendar years after 2024, these platforms must backup withhold only if both thresholds are exceeded or they made reportable payments to you the year before.

Card payments follow a different rule. If clients pay you directly by credit, debit or gift card, the processor reports those payments on Form 1099-K at any amount. A platform may also send a 1099-K below the federal thresholds, and some states set lower ones; California, for example, keeps $600 for app-based drivers.

A missing form does not make income tax-free

The IRS states that all income is taxable unless the law excludes it, even if you don’t get a Form 1099-K, and that reporting and backup-withholding thresholds don’t affect whether income is taxable. Higher thresholds mean fewer forms, not less income to report. A client that paid you $1,800 in 2026 generally won’t file a 1099-NEC, but the $1,800 is still gross receipts on Schedule C. Some clients will keep sending forms for smaller amounts, which the IRS allows and encourages.

Payment method matters too. Payments made by card or through a payment app are reported under the 1099-K rules rather than on Form 1099-NEC. A client that pays you through an app should not send a 1099-NEC for those payments, and if your app total stays under the thresholds, you may get no form at all.

Reconciling 2026 forms with your books

Start from your own records, not the forms. A per-client ledger built from dated invoices, as described in simple bookkeeping for freelancers, makes the match quick. The invoice numbers and payment dates covered in what to put on a freelance invoice are what you compare line by line.

Example: 2026 books with $48,000 of receipts.

Payer Paid by In your books Form to expect Amount on forms
Client A Bank transfer $30,000 1099-NEC ($2,000 or more) $30,000
Client B Check $1,500 None (under $2,000) $0
Client C Payment app, 40 payments $9,000 None (not over $20,000 and 200) $0
Card sales Card processor $7,500 1099-K (any amount) $7,500
Total $48,000 $37,500

The forms show $37,500, but gross receipts are $48,000; the $10,500 with no form behind it is still income. If the processor deposited $7,275 because it kept $225 in fees, record $7,500 of receipts and a $225 expense. Form 1099-K reports the gross amount, before fees, refunds, credits and shipping, which you account for separately.

Then work through any differences:

  • A 1099-NEC that doesn’t match a client’s total usually traces to year-end timing, reimbursed expenses included in the payment, or a card or app payment that belonged on a 1099-K.
  • If one payment appears on both a 1099-NEC and a 1099-K, your return should reflect what you actually received, so count it once and keep the reconciliation with your records.
  • If a form is wrong, ask the issuer for a corrected one. The IRS cannot correct a Form 1099-K, and it tells taxpayers not to delay filing while waiting for a correction.

What clients and other payers must do for 2026 payments

  • Collect Form W-9 with the payee’s taxpayer identification number before paying. Without a correct number, reportable payments are subject to 24% backup withholding.
  • Track what each nonemployee is paid for services in the course of the business, and file Form 1099-NEC when the 2026 total reaches $2,000. Payments to corporations are generally exempt, but attorneys’ fees are reportable even when the law firm is a corporation.
  • Leave card and payment-app payments off Form 1099-NEC; the processor or platform handles them.
  • E-file when the business has 10 or more information returns of all types combined. Beginning with tax year 2026, the Information Returns Intake System (IRIS) is the only IRS intake system, and a Transmitter Control Code application is typically processed within 45 business days, so apply well before January.
  • Furnish and file Form 1099-NEC by Monday, February 1, 2027. No automatic extension is available for this form.

Due dates for 2026 information returns

Form, 2026 payments Copy to recipient Filing with the IRS
1099-NEC Mon., Feb. 1, 2027 Mon., Feb. 1, 2027, on paper or electronically
1099-MISC (most boxes) Mon., Feb. 1, 2027 Mon., Mar. 1, 2027 on paper; Wed., Mar. 31, 2027 electronically
1099-K Mon., Feb. 1, 2027 Mon., Mar. 1, 2027 on paper; Wed., Mar. 31, 2027 electronically

The base dates are January 31 for recipient copies and for 1099-NEC filing, and February 28 (March 31 if filed electronically) for the other forms. Publication 1099 moves any due date that falls on a Saturday, Sunday or legal holiday to the next day that is none of those, and January 31, 2027 and February 28, 2027 are both Sundays. Freelancer tax deadlines for 2026 and 2027 puts these dates next to the estimated tax deadlines.
